Oni Me Software User Service Agreement

  1. Introduction

1.1 Description of the Terms of Service

We have created these Terms of Service ("Terms") to clarify the relationship of rights and obligations between you and us, which in some cases may still have the characteristics of a traditional contract. We try to write them in a way that is easy to understand, so please read them carefully on your side.

1.2 Consent to use the Service

By using the Service, you agree to abide by these Terms. If you do not agree to these Terms, please do not use our Services. You will not be allowed to use our platform or applications.

1.3 Scope of the Terms of Service

The following Terms of Service outline your obligations when using our Platform or Services (as defined below), including selling products and generating User Contributed Content through the Services. We recommend that you also review our Privacy Policy, which is part of the Terms of Service and details how we treat any personal information you provide.

1.4 Ownership and Use of the Service

The Service ("Platform") is operated by us. By accessing and using any part of the Service, you accept and agree to abide by all of the terms and conditions set forth in this Agreement. Please read and understand these Terms of Service carefully before interacting with the Platform. If you do not agree to any of these terms and conditions, you will not be able to access the Platform or use any of the Services. Please note that these terms may not be exchanged or transferred with third parties.

1.5 Arbitration Clause

These Terms contain an arbitration clause. Except for certain special disputes, you agree to resolve disputes between us through mandatory arbitration. You and we both waive the right to participate in a class action or class arbitration.

2. Service rules

Commitment to Use the Software By using the Software, you acknowledge and accept it as a platform for information sharing, transmission and access. When using the Software services, you are required to comply with the laws, regulations and standards set forth in this Agreement. You are solely responsible for all operations performed under your registered account, including any content transmitted, and accept the consequences thereof. This content includes graphics, video messages, comments and other materials generated during your use of the Software and its services. Please evaluate the content of the Software carefully and if you have any questions, you may contact us through the customer service contact information provided in this Agreement.

OPINIONS AND RESPONSI: The opinions or policies expressed in any content you post or transmit through the Software Services are not ours. We assume no responsibility for them and reserve the right to take prompt and appropriate action in accordance with laws, regulations and this Agreement, including the relevant provisions in Section 5.

Authenticity of Information and Legal Liability You are solely responsible for the authenticity, legality and validity of the information transmitted through the Software and bear any legal liability arising therefrom. We reserve the right to take prompt and appropriate action in accordance with laws, regulations and the terms of this Agreement (including the relevant provisions of Article 5) to deal with legal liabilities arising from the information transmitted by you.

Right of Service Adjustment We reserve the right to modify, suspend, reorganize, terminate or cancel all or part of the software service for business development. You are advised to take appropriate precautions against such risks.

Information and Related Services It is important to realize that the services provided by the Software may contain information and other content pushed by third-party providers and partners. By checking the checkboxes, you agree to receive such information. Pushes may take the form of information streams or floating window pushes. We guarantee to provide the ability to turn off the relevant pushes with one click, or you have the right to turn off push notifications in the form of floating windows in accordance with laws and regulations. You can manage and modify Oni Me's notification permissions in System Settings - Application Management. We reserve the right to associate or display links through the relevant pages, the form and scope of which may change without prior notice.

When using the Software, you are obliged to comply with international laws, regulations and social norms. You shall not engage in the following behaviors or publish, transmit, disseminate or store the following contents through the Software or its services:

   (1) Actions that violate the basic principles of law;

   (2) Acts that jeopardize network security;

   (3) Endangering the security, honor and interests of any country;

   (4) Leakage of state secrets;

   (5) Promoting terrorism, extremism;

   (6) Disseminating violent, obscene or pornographic content;

   (7) Producing, publishing or disseminating information that violates the security of children's personal information;

   (8) fabricating and disseminating false information in order to disrupt economic and social order

   (9) Violating others' right to reputation, privacy, intellectual property or other legitimate rights and interests;

   (10) Stalking or harassing others, illegally intruding into others' networks, interfering with the normal functioning of others' networks, stealing network data, or other acts that jeopardize network security;

   (11) Providing programs and tools designed to intrude into networks, interfere with network functions, steal network data, or provide technical support for the above activities, as well as other acts that jeopardize network security;

   (12) Uploading, posting or sending information containing computer viruses or other computer codes, files and programs that interfere with, damage or limit the function of any computer software, hardware or communication equipment;

   (13) Acts that violate laws, regulations, public order, social norms or requirements for authenticity of information;

   (14) Publishing other contents prohibited by laws, regulations or administrative provisions;

   (15) Dissemination of information that violates laws, regulations, policies, public order, social norms, or information that interferes with the normal operation of the software or infringes on the legitimate rights and interests of other users or third parties.

Prohibited Actions Unless permitted by law or with our written permission, you may not engage in the following actions:

   (1) Induce other users to click on linked pages or share information;

   (2) Use the Software and any of its features or third-party operating platforms to advertise or promote each other without our written permission;

   (3) Posting, transmitting or disseminating harassing messages, advertising messages, excessive marketing messages, spam, or messages containing any pornographic or suggestive content;

   (4) Producing or distributing methods or tools related to the above behaviors, or operating or distributing such methods or tools, whether or not for commercial purposes;

   (5) Other acts that interfere with the normal operation of the Software or are not expressly authorized by us.

CONTENT REVIEW AND LEGAL ACTION We reserve the right to intervene and block the transmission of any content that, in our reasonable judgment or our internal risk control model, violates any relevant laws, regulations or the provisions of this Agreement, or that infringes upon, impedes or threatens the rights or safety of any individual. We may, in our sole discretion, take appropriate legal action against such content or behavior, including, but not limited to, removing illegal, infringing or inappropriate content from the Software Services, restricting or terminating the qualifications of the offending user, and prohibiting him or her from using the Software Services in whole or in part.

Ownership and Operation of the Service The Service is owned and operated by us. The Service will be provided in strict accordance with our published service rules, terms of service and operating instructions. All rights related to the Service and all other rights not expressly authorized by this Agreement remain with us. Except as expressly provided, we will not waive, assign or grant any other authorization or license to the relevant rights and benefits.

Third-Party Services When using third-party products or services offered on our Software Platform, in addition to complying with the provisions of this Agreement, you are subject to that third party's user agreement. For any disputes arising from the use of third-party products or services, we and the third party will each be liable in accordance with the law and the agreement.

 Account Initialization When you select the Quick Login option, we immediately create a unique identifier for you. You may cancel or delete this account, but you may not sell it. You are obligated to retain this ID.

 Prohibition of Malicious Registration and Illegal Activity Malicious account registration, including, but not limited to, impersonating another person, or using your account to engage in illegal activity, disrupt, harass, or defraud other users, is strictly prohibited. Violation of this Agreement may result in permanent deactivation and liability for any damages incurred by the user. We reserve the right to report such behavior to judicial authorities.

Account Information Security You are responsible for the safekeeping of your registered account information. You agree that operations performed under your account are legally binding. Under no circumstances may you use another person's account, and you should notify us immediately of any unauthorized use of your account.

COMPLIANCE WITH TERMS OF SERVICE Compliance with the terms of this Agreement is essential and requires legal, proper and appropriate use of the Service. Violations of the Terms may result in termination of the Service, as described in the "Liability" section of Section 10 of this Agreement, which details the responsibilities and legal consequences of violations of the Terms. In addition, we reserve the right to cancel your account under the terms of this Agreement and in other reasonable circumstances.

3. Service Content

In addition to the Software "Services" outlined in the "Introduction" section of this Agreement, the "Instant Messaging" service we previously offered included the following features. However, due to changes in market demand, these features are no longer available. Please note that the features of the service displayed on the Oni Me mobile terminal will determine the available options:

Rich Content Oni Me offers a wide range of visual and written content, including tutorials, great work, personal stories, and more to meet the needs of its users. Functions to Enhance User Experience Oni Me integrates a comprehensive range of functions to enhance the user experience, including commenting, liking, following, blocking and more.

4.Personal Information Protection

Basic Principles The protection of Users' personal information is our basic principle. We will collect, use and securely store your personal information in accordance with this Agreement and the Oni Me Privacy Policy. In the event of a conflict between the terms of this Agreement and the Oni Me Privacy Policy with respect to the protection of personal information, the Oni Me Privacy Policy shall prevail, except as expressly provided in this Agreement. PRIVACY PRIORITY We recognize the importance of personal information to you and therefore prioritize the protection of your privacy and personal information by making every effort to treat and handle it with care. For rules on the handling and protection of personal information, your rights to manage your personal information, etc., we recommend that you read the Oni Me Privacy Policy carefully before registering for an account, or you can access it at any time while using the Software.

 5. Intellectual Property and Trade Secrets

1. Attribution of Intellectual Property Rights Graphics, videos, text or components thereof, as well as other logos, product names and service names contained in the Software or in the Services provided are our intellectual property. You may not display or use our logos in any way for profit without our prior written consent. In addition, you must not imply that you have the right to display, use or otherwise manage our Marks.

2. Copyright and other intellectual property rights The copyright, trademarks, patents and all other intellectual property rights in the Software, as well as all trade secrets and information content (including, but not limited to, text, software, scripts, codes, designs, layouts, etc.) relating to the Software, as well as images, sounds, music, videos, applications, image analysis, query functions and other content relating to the Software are protected by laws, regulations and corresponding international treaties. The software is protected by laws, regulations and international treaties. The exclusive rights to all of the above content are reserved exclusively to us.

3. Prohibition of modification and hacking Modification of the Oni Me Client Program without our express permission is prohibited. Reverse engineering, decompiling or disassembling Oni Me, as well as destroying its integrity (including program code, data, etc.) is strictly forbidden.

4. Prohibition of creation and distribution of destructive software It is prohibited to create or distribute any third-party software that harms our interests or interferes with the normal use of the software without our authorization.

 6. Legal Liability

Indemnification and Legal Consequences If a third party files any claims, demands or incurs damages (including attorney's fees) against us, our partners or other users as a result of your violation of this Agreement or applicable laws and regulations, we reserve the right to take measures, including, but not limited to, suspending or terminating your account, restricting your use of the Services, and taking legal action. We reserve the right to revoke your account privileges if your behavior involves illegal activities, disruption of public order, serious interference with the use of the platform, improper use of the software, harassment or deception of other users and will cooperate with judicial investigations when required.

Lawful use of information You are responsible for ensuring that any information obtained through Oni Me is used for lawful purposes. Any behavior that violates the law, public order, public morals or this Agreement is strictly prohibited. In the event of such a violation, you are responsible for resolving any disputes that arise and for assuming all related legal and financial liabilities.

Content Uploading and Storage As an internet service provider, Oni Me provides users with the service of uploading space for the public sharing of content such as text, images and videos. Content transmitted by Users is securely stored and encrypted by Oni Me, but uploaded videos may be tagged by the platform's Corner Video feature.

ASSIGNMENT OF AGREEMENT Except as otherwise provided herein, you may not transfer or assign this Agreement or any of the rights described herein.

COMMUNICATION TOOLS AND RISKS You acknowledge that Oni Me, as a communication tool, cannot predict or address the risks that may arise from online interactions, including but not limited to direct, indirect, incidental, special and consequential damages. You are solely responsible for sending or posting messages through Oni Me. For more information on our handling of user information, please refer to the Oni Me Privacy Policy.

 7. Notifications and services

Notification channels: All notices relating to the Software and the User Agreement may be communicated through the Software interface and by e-mail.

Notification of Important Matters: We will take important steps to alert you to matters that directly affect your interests through the above notification channels. Such notices shall be deemed to have been effectively delivered to the user on the date they are sent.

Applicable Law and Dispute Resolution: This Agreement is subject to applicable law, dispute resolution mechanisms and other terms.

Severability of Terms: If any provision of this Agreement is held to be invalid or unenforceable for any reason, in whole or in part, the remaining provisions will remain valid and enforceable.

Applicable Law : The interpretation, validity and resolution of disputes arising out of this Agreement shall be governed by the applicable law.

Dispute Resolution: If any dispute or controversy arises between you and us, you should first endeavor to resolve it through amicable negotiations. If negotiations are unsuccessful, you agree to submit the dispute or controversy to a court of competent jurisdiction for resolution by litigation.
